Terms of Service
Welcome to Digital Frontier Tech (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of digitalfrontiertech.com and any products or services we provide, including custom PC builds, networking, low voltage installation, and consulting (collectively, the “Services”). By using our site or engaging our Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian, to use our Services. By using our Services you represent that you meet this requirement.
2. Services We Offer
- Custom PC design, assembly, sales, and configuration.
- Network design, consultation, and implementation.
- Low voltage cabling, cameras, access control, and audio installation (managed through our FieldWyre platform).
- Ongoing support, upgrades, and maintenance.
Detailed scope, deliverables, pricing, and timelines for any specific engagement will be set out in a written quote, invoice, or statement of work (“Order”). The Order, together with these Terms, forms the agreement between us.
3. Quotes, Orders, and Pricing
- Quotes are valid for the period stated on the quote (default 14 days) and may be revised if component pricing or availability changes.
- An Order is accepted when you approve it in writing (including email) and, where applicable, pay any required deposit.
- Prices are in U.S. Dollars and exclude applicable taxes and shipping unless stated otherwise.
4. Payment
- A deposit may be required before we order parts or schedule installation.
- Final payment is due as stated in the Order (typically on delivery, installation, or net 7-30 days for approved business accounts).
- Late payments may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.
- Returned-payment fees and reasonable collection costs (including attorneys’ fees) may be added to delinquent balances.
5. Delivery, Installation, and Risk
Delivery and installation timelines are estimates. We are not responsible for delays caused by component shortages, shipping carriers, or factors outside our reasonable control. Risk of loss for hardware passes to you upon delivery or installation, whichever is earlier.
6. Warranties
Hardware
Component-level warranties are provided by their respective manufacturers and pass through to you. We will reasonably assist with warranty claims during the first 90 days following delivery.
Workmanship
We warrant our assembly and installation workmanship for 90 days from completion. If our workmanship is defective during that period, we will, at our option, repair or rework the affected work at no charge.
Disclaimer
EXCEPT AS EXPRESSLY STATED, SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Returns and Cancellations
- Custom-built systems and special-order components are non-refundable once production has begun, except where required by law.
- Defective items will be repaired or replaced under the applicable warranty.
- If you cancel a project after work has begun, you remain responsible for parts ordered and labor already performed.
8. Customer Responsibilities
- Provide accurate project information, site access, power, and any required permissions for installation.
- Back up your data before we service or upgrade existing equipment. We are not responsible for data loss.
- Comply with applicable laws, codes, and homeowner/landlord/HOA requirements at the install site.
9. Software and Third-Party Products
Software, firmware, and third-party platforms installed or configured by us are licensed under their own terms. Use of bundled software is also subject to our End User License Agreement.
10. Intellectual Property
All content on this website (text, images, logos, code) is owned by Digital Frontier Tech or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or redistribute site content without written permission, except for personal, non-commercial use.
11. Acceptable Use
You agree not to: (a) use the site or Services for unlawful purposes; (b) attempt to access systems or accounts you are not authorized to access; (c) introduce malware or interfere with the site’s operation; (d) scrape or harvest content without permission; or (e) misrepresent your identity or affiliation.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DIGITAL FRONTIER TECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SPECIFIC SERVICE OR PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold Digital Frontier Tech harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
14. Termination
We may suspend or terminate your access to the site or Services at any time for breach of these Terms or for any lawful reason. Sections that by their nature should survive termination (including payment obligations, warranties, disclaimers, limitations of liability, and dispute resolution) will survive.
15. Governing Law and Venue
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. The exclusive venue for any dispute is the state or federal courts located in Ocean County, New Jersey, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. Updated Terms are effective when posted on this page. Your continued use of the site or Services constitutes acceptance of the updated Terms.
